By accessing and using the services provided by Skyline Logistics, you confirm that you are at least 18 years old and are legally capable of entering into a binding contract. These Terms of Service constitute a legally binding agreement between you (“the Customer”) and Skyline Logistics. You agree to be bound by these Terms, as well as any additional terms, conditions, or policies referenced within this document or on our website.
2. Services Provided
Skyline Logistics offers a range of logistics services, including:
- Car Shipping: We transport vehicles, including personal cars, motorcycles, and other motorized vehicles, across the United States.
- Trucking Services: We provide trucking services for the transportation of furniture, household items, heavy equipment, and other freight.
- Door-to-Door Service: Our logistics services include door-to-door pickup and delivery within the United States, subject to location accessibility.
We reserve the right to modify, discontinue, or update any of our services without prior notice. Skyline Logistics is not responsible for any issues or delays caused by factors outside our control, such as weather conditions, road closures, or government regulations.
3. Pricing and Payment
When requesting a quote or booking our services, you will receive a price estimate based on the information provided, including the type of service, shipment size, distance, and any additional handling requirements. The price may vary depending on the following factors:
- Type of Service: Pricing differs for car shipping, trucking, or other logistics services.
- Distance: The distance between the pickup and delivery locations significantly impacts the overall cost.
- Timing: Urgent or expedited shipping may result in higher charges.
- Additional Services: Services such as enclosed transport for cars or handling of oversized items may incur extra fees.
Payment Terms:
- All payments are due in full at the time of service booking unless otherwise agreed upon.
- We accept major credit cards, debit cards, and other payment methods specified on our website.
- Failure to make timely payment may result in the cancellation of your booking.
Skyline Logistics reserves the right to adjust pricing based on market conditions, fuel costs, or other external factors. We will notify you of any changes that may affect your order.
4. Cancellation and Refund Policy
If you need to cancel or modify your booking, please contact us as soon as possible. Our cancellation policy is as follows:
- Full Refund: You are eligible for a full refund if the cancellation is made at least 48 hours prior to the scheduled pickup time.
- Partial Refund: If the cancellation is made less than 48 hours before the pickup, a partial refund may be issued at Skyline Logistics’ discretion.
- No Refund: Once the shipment process has begun, cancellations are not eligible for a refund.
Refunds will be processed through the original payment method used at the time of booking. Please allow up to 7 business days for refunds to reflect in your account.
5. Shipment and Delivery Terms
Skyline Logistics strives to provide timely and efficient shipping and delivery services. However, shipment times are estimates and are subject to factors outside our control, including but not limited to weather, road conditions, and mechanical issues. The following terms apply to all shipments:
- Pickup and Delivery Windows: You will be provided with estimated pickup and delivery windows based on the service type and destination. Delays may occur, and we are not responsible for delays caused by factors beyond our control.
- Inspection: Upon pickup, both the customer and our driver will inspect the vehicle or items to document their condition. A similar inspection will be conducted upon delivery. It is the customer’s responsibility to inspect the shipment upon delivery and notify Skyline Logistics of any issues immediately.
- Accessibility: If the pickup or delivery location is inaccessible to our trucks, we will coordinate an alternate nearby location for pickup or delivery.
- Loss or Damage: All shipments are covered by basic insurance. However, customers can request additional coverage for high-value items or vehicles. Any loss or damage claims must be reported immediately upon delivery.
6. Customer Responsibilities
As a customer, you agree to the following responsibilities:
- Accurate Information: You must provide accurate and complete information regarding your shipment, including the type of vehicle or items, pickup and delivery addresses, and any special handling requirements.
- Payment: You agree to pay all applicable fees and charges associated with your shipment, as outlined in your booking confirmation.
- Inspection: You are responsible for inspecting the condition of your vehicle or items before and after shipment. Any issues must be reported promptly.
- Compliance with Laws: You agree to comply with all applicable laws, regulations, and customs requirements when using Skyline Logistics’ services.
Failure to comply with these responsibilities may result in delays, additional fees, or cancellation of services.
7. Limitation of Liability
Skyline Logistics is committed to providing high-quality logistics services. However, we are not liable for any damages or losses that occur under the following circumstances:
- Delays: We are not responsible for delays caused by factors outside our control, including weather, traffic, or mechanical failures.
- Loss or Damage: While we take every precaution to ensure the safety of your shipment, Skyline Logistics is not responsible for loss or damage to items or vehicles due to circumstances beyond our control. Customers should ensure their shipments are adequately insured.
- Third-Party Services: Skyline Logistics may engage third-party carriers or subcontractors for specific services. We are not responsible for the actions or omissions of these third parties.
In no event shall Skyline Logistics be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, business, or data.
8. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the state of South Carolina, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the services provided by Skyline Logistics shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
By using our services, you agree to waive your right to bring a lawsuit in court and participate in class action lawsuits.
